Terms & Conditions

1. Acceptance of Terms

By accessing or using any website, mobile application, or service operated by MotherCoder Labs LLC ("MotherCoder Labs," "we," "us," or "our"), including but not limited to any apps advertised or distributed through our website, you ("User" or "you") agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use our services.

These Terms apply to all visitors, users, and others who access or use any of our Services.

 

2. Description of Services

MotherCoder Labs LLC provides a portfolio of mobile applications ("Apps") and an informational website that advertises, links to, and supports those Apps (collectively, the "Services"). The specific features and functionality of each App may be subject to additional terms presented within the App itself. In the event of a conflict between these Terms and any App-specific terms, the App-specific terms shall govern with respect to that App.

 

3. Eligibility

You must be at least 13 years of age to use our Services. If you are under 18, you represent that you have obtained parental or guardian consent to use the Services. By using our Services, you represent and warrant that you meet the applicable eligibility requirements.

 

4. User Accounts and Data

4.1 Account Registration

Certain features of our Apps may require you to create an account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

By using our Services, you acknowledge that we may collect personal information and usage data as described in our Privacy Policy. Such data may include, but is not limited to:

  • Device identifiers and operating system information

  • Usage data and in-app activity

4.3 Account Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our discretion.

 

5. Acceptable Use

You agree not to use the Services to:

  • Violate any applicable federal, state, local, or international law or regulation

  • Transmit any unsolicited or unauthorized advertising or promotional material

  • Impersonate or attempt to impersonate MotherCoder Labs, an employee, another user, or any other person or entity

  • Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Services

  • Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Services or any server, computer, or database connected to the Services

  • Use any robot, spider, or other automatic device, process, or means to access the Services for any purpose, including monitoring or copying any of the material on the Services

  • Introduce any viruses, Trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful

 

6. Mobile Communications
 
6.1 Opt-In Consent

 

Certain features of our Apps or website may allow you to opt in to receive SMS text messages or push notifications from MotherCoder Labs LLC. By opting in to any such mobile communications program, you expressly consent to receive those communications from us. Message and data rates may apply. Message frequency may vary depending on your activity and preferences.

 

6.2 No Third-Party Sharing of Opt-In Data

 

Mobile opt-in data — including your phone number, consent records, and notification preferences collected through any SMS or push notification opt-in process — will never be shared with, sold to, or disclosed to any third parties or affiliates for any purpose, including marketing. This prohibition applies regardless of the nature of the third party and includes marketing partners, data brokers, advertisers, and affiliated entities.

 

6.3 How to Opt Out

 

You may opt out of SMS communications at any time by replying STOP to any message you receive from us. You may opt out of push notifications at any time through your device settings or within the App's notification preferences. Opting out of mobile communications will not affect your ability to access or use the Services. For help, reply HELP to any SMS message or contact us at hello@mothercoderlabs.com.

 

6.4 Governing Policy

 

The collection and use of mobile opt-in data is further governed by our Privacy Policy, which is incorporated into these Terms by reference. In the event of a conflict between this Section 6 and the Privacy Policy with respect to mobile opt-in data, the more protective provision shall apply.

 

7. Intellectual Property

The Services and their entire contents, features, and functionality — including but not limited to all software, text, graphics, logos, icons, and images — are owned by MotherCoder Labs LLC or its licensors and are protected by United States and international copyright, trademark, patent, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial purposes. You may not reproduce, distribute, modify, create derivative works of, publicly display, or commercially exploit any of the materials from our Services without prior written consent from MotherCoder Labs LLC.

 

8. Third-Party Links and Services

Our website and Apps may contain links to third-party websites, app stores (such as the Apple App Store or Google Play Store), or services that are not owned or controlled by MotherCoder Labs LLC. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services. We encourage you to review the terms and privacy policies of any third-party services you visit.

 

9. Disclaimers

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. MOTHERCODER LABS LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Services will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant or make any representations regarding the use or the results of the use of the Services in terms of correctness, accuracy, reliability, or otherwise.

 

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MOTHERCODER LABS LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your access to or use of (or inability to access or use) the Services

  • Any conduct or content of any third party on the Services

  • Any content obtained from the Services

  • Unauthorized access, use, or alteration of your transmissions or content

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE GREATER OF ONE HUNDRED DOLLARS ($100) OR THE AMOUNTS PAID BY YOU TO MOTHERCODER LABS LLC IN THE PAST TWELVE (12) MONTHS.

 

11. Indemnification

You agree to defend, indemnify, and hold harmless MotherCoder Labs LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Services.

 

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States of America, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the federal or state courts located in California, and you hereby consent to personal jurisdiction and venue in such courts.

Any dispute arising out of or relating to these Terms or the Services that cannot be resolved informally shall be submitted to binding arbitration in accordance with the American Arbitration Association's Consumer Arbitration Rules, except that either party may seek injunctive or other equitable relief in any court of competent jurisdiction.

 

13. Changes to These Terms

We reserve the right to modify these Terms at any time at our sole discretion. If we make material changes, we will notify you by updating the "Effective Date" at the top of this page and, where appropriate, by sending a notification through the App or to your registered email address. Your continued use of the Services after any changes constitutes your acceptance of the new Terms. We encourage you to review these Terms periodically.

 

14. Severability and Entire Agreement

If any provision of these Terms is held to be invalid, illegal, or unenforceable under applicable law, such provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions of these Terms shall continue in full force and effect.

These Terms, together with our Privacy Policy and any App-specific terms, constitute the entire agreement between you and MotherCoder Labs LLC regarding your use of the Services and supersede all prior agreements and understandings.
